BUSINESS AVIATION - LEGAL AND REGULATORY TOOLKIT IN AN INTERNATIONAL CONTEXT
Objectives
From a business aviation operator perspective and with a focus on EU legislation, to understand, know and handle the basic legal tools to deal with questions that have a link with different jurisdictions.
Teaching objectives
Understand the international legal environment of business aviation ;
Identify when and to whom an international convention applies, with a focus on fiscal treaties ;
Determine in a specific situation which domestic law applies ;
Master the key contents of international labor, social security and pension law ;
Know the ICAO unified legislation on personnel licensing (annex 1) ;
Identify the main questions in relation with staff and company civil and criminal liability ;
Get keys notions on international dispute settlement.
Participants
Representatives at management level from business aviation-related undertakings with responsibilities in the HR, Finances and/or Legal scope;
Individuals such as entrepreneurs, investors, independent pilots, whose activities in business aviation face legal and regulatory issues.
Prerequisites
Professional experience in dealing with business aviation activities;
Language level appropriate to take part in the training.
Content
Business aviation international legal environment ; different stakeholders and identification of the employer ;
Method of dealing with multiple applicable legislation (+ exercises) ;
Labour law (EU/international) questions ;
Social security & pensions (EU/international) questions ;
Taxation of revenues in an EU/international context; methods and tools to eliminate double taxation ; focus on personal incomes ;
Staff licensing under ICAO Annex 1 ;
Nationality of the operator and determination criteria ;
Civil and criminal liability of pilots and operator ;
International dispute settlement (choice of forum and arbitration).
